Man , 31 Gets 5 years For Manslaughter(updated)
The Lusaka high court has sentenced a 31 year old man to 5 years to imrpsonment with hard after he pleaded guilty to man slaughter. This is in a curse in which Daudi Mwenda was charged with manslaughter contraly to the laws of Zambia.
Mwenda is alleged to have casused the death f Dickson kanyembo on 20th, December 2010 in Lusaka.
According to the postmortem , report conducted on December 19th, the casue of death was blood in the brain, due to head injury. The accused told Judge Florence Lengalelenga that the fact were true true and correct and she convicted hime upon the own guilty plea and admission of facts.
In mitigation, Mwenda said hewas very sorry for what happened. Mwenda said while he conceded that he had no right to assualt Kanyembo he urged the court to weight his conduct against that of the diseased. But in passing sentence, Juge Lengalenga said mwenda had no right to behave the way he did, and because of his beahveoiur the life was lost.
She said Mwenda should have avoided the situation by walking away.
Judge lengelenga said even as I exercise maximum leniency, they should be a reminder to the convict to control his temper, in order to stay out of trouble in future and then sentence him to 5 years imprisonment with hard labor.
