Hearing In ACC-Police Assault Case Set For July 13
The Lusaka Magistrate Court is tomorrow July 13th 2011 expected to deliver a ruling on whether to go ahead or stop criminal proceedings against four Anti-Corruption Commission (ACC) officers.
This is in a case in which the quartet is alleged to have assaulted a paramilitary police officer who they suspected of being involved in a corruption scandal.
Lusaka Resident Magistrate Aridah Chulu adjourned ruling date which was initially set for July 11TH to July 13TH 2011 saying the ruling was not ready.
The defense team requested the court to exclude the four officers from trial and prosecution on the account that they are immune to civil and criminal examination in the course of duty.
But state prosecutor Ben Moono objected to the application saying the officers are appearing in court as individuals and not as officers of the state.
Mr. Moono has also applied that the defense team comprising of ACC prosecutors be disallowed from representing the four saying prosecutors are officers of the court and not lawyers.
He argued that both the ACC and the police service serve the interest of government and that there is no reason for Anti Corruption Commission prosecutors to defend ACC investigators who have been charged as individuals.
The four ACC investigators namely Christopher Musonda Mutila, Chiinga Chuba, Clement Chansa and Emmanuel Mwange have been dragged to court for assaulting Francis Mugala a paramilitary police officer.
