Kitwe High Court jails man 68 years
THE Kitwe High Court has jailed a 36-year-old man to 68 years imprisonment on four counts of aggravated robbery.
High Court Judge Judy Mulongoti jailed Charles Tembo of 338 Wusakile Township to 17 years imprisonment each on the four counts of aggravated robbery he committed in July last year.
The sentences will however run concurrently.
Tembo, who at the time of the offence was with other unknown persons, was earlier charged with six counts of aggravated robbery but the State entered a nolle prosequi in respect of two counts.
Passing the sentence, Madam Justice Mulongoti said it was clear from the evidence that one of the victims was kicked and beaten by the accused person.
The court noted that Tembo even stabbed the victim with a knife which was found on him when he was apprehended.
Madam Justice Mulongoti said although the accused and his friends were armed, there was no evidence to suggest that the gun was used or that it was capable of causing death.
She said as a result, she found the accused person guilty of ordinary aggravated robbery without a firearm.
In mitigation, Tembo said he deserved leniency as the offence did not have any aggravating circumstances.
He told the court that there was no use of violence leading to serious injury and that there was threat of use of violence as opposed to actual violence.
According to the evidence in court, Tembo attacked a Kitwe resident and got away with K2.2 million while in another incident, he attacked three people who had just closed Jazzy Lazzy Club in Parklands area and ordered them to lie down.
He searched their pockets, grabbed some money and mobile phones and further ordered one of the victims to open the club where he got K793, 000, packets of cigarettes and Nikolai beer.
